What Representation Looks Like

Mustain Law Firm can provide drivers with meaningful access to the legal process. Depending on the facts of the case and the scope of representation, that may include:

  1. Raising available factual and legal defenses with the prosecutor before trial and requesting appropriate relief;

  2. Requiring the citing officer or other necessary witnesses to appear for trial and moving for dismissal when the State cannot proceed; and

  3. Preparing for trial and representing the driver through trial when the driver rejects a negotiated resolution and wants their day in court.

Due-process representation does not guarantee that a charge will be dismissed or reduced. It gives the driver an opportunity to challenge the allegation, require the State to prove its case, and make an informed decision about whether to negotiate or proceed to trial.

Will I Have to Appear?

The firm can often appear for the client, but this depends on the court and the case. Unless Mustain Law Firm confirms in writing that your appearance is excused, you should attend every scheduled court date.

How to Get Started

1. Contact Mustain Law Firm, PLLC

Send a clear copy of the front and back of your citation, along with your full name, date of birth, and contact information.

2. We Review Your Matter

The firm will conduct a conflict check, review the information provided, and determine whether it can offer representation. Please allow two to three business days for this process. Weekends and holidays are not included.

3. Sign and Pay

If the firm accepts the case, you will receive an electronic representation agreement. Representation begins only after the agreement is signed and the required initial fee is paid.

4. Complete Onboarding

You will receive access to MyCase, where you can complete your intake, upload documents, and communicate with the firm.

When Does Representation Begin?

Submitting a citation or speaking with the firm does not create an attorney-client relationship. Representation begins only when:

  1. Mustain Law Firm accepts the case;

  2. The representation agreement is signed; and

  3. The required initial fee is paid or another written arrangement is approved.

Until then, you remain responsible for all court dates and deadlines.
